Terms and Conditions

I, the undersigned dog (Camper) owner, hereby acknowledge and agree that all the information provided in this Registration Form is complete and accurate to the best of my knowledge. I consent to Camp Miracle Paws, their affiliates and any related entities, use of such details for all lawful and legal business grounds which may include but is not limited to providing Camp Miracle Paws services to you, and using data that includes information about your Camper for advertising or other purposes. I further acknowledge and verify that I have read, understand and agree to all the terms and conditions included in the Waiver of Liability, Camper Release, and Assumption of Risk and Indemnification Agreement, as they may be revised from time to time, which are attached and fully incorporated into this registration form by reference. I hereby execute this Registration and the Agreement for my Camper, myself, my heirs, successors, representatives and or assigns. I further certify that if I am not the owner or exclusive owner of the Camper(s) for whom this Camper Registration Form has been completed for, my signature is acceptable to enter into this Agreement for and on behalf of any other owner or representative. If signing my name electronically, I hereby agree that my signature will be regarded an original and take the place of my wet-ink signature. If signing in ink, I hereby agree that a true copy of this document may be produced in lieu of the original registration. Should a copy be provided, I understand that it is legally enforceable and does not affect the terms of the registration in any way. By signing the Camper Registration Form, I Acknowledge and Agee that my dog(s) will be socializing with dogs with other families while participating in Camp Miracle Paws services. No amendments, modifications, or supplements to this Agreement shall be valid unless agreed to in writing and signed by both parties.
CAMPER RELEASE, WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNIFICATION AGREEMENT (THE “AGREEMENT”)THIS AGREEMENT INCLUDES A RELEASE OF LIABILITY AND WAIVER OF LEGAL RIGHTS AND DENIES YOU OF THE RIGHT TO SUE THE OWNER(S) OF ANY CAMP MIRACLE PAWS LOCATION OR RELATED PARTIES. DO NOT SIGN INTO THIS AGREEMENT UNLESS YOU HAVE READ AND FULLY UNDERSTAND IT IN ITS ENTIRETY. YOU MAY WANT TO SEEK THE ADVICE OF LEGAL COUNSEL IF YOU ARE UNSURE OF ITS EFFECT.

In consideration for your dog(s) also known as (“Camper”) being permitted to come to Camp or use in-home pet training services, you agree to all of the policies, procedures, release, terms and conditions set forth below. The following Agreement will apply at each Camp location, as well as to Camp Miracle Paws, a South Carolina LLC, and its affiliates, employees, owners, agents and representatives.

ACCEPTANCE AND ACKNOWLEDGMENT OF RISK. YOU FULLY UNDERSTAND THAT: (a) THERE ARE INHERENT AND POTENTIAL RISKS THAT COULD RESULT IN PROPERTY DAMAGE, BODILY INJURY, ILLNESS OR DEATH INVOLVED WITH INTERACTIONS BETWEEN HUMANS AND DOGS, AS WELL AS BETWEEN DOGS AND OTHER DOGS, WHICH COULD RESULT IN PROPERTY DAMAGE OR BODILY INJURY, INCLUDING BUT NOT LIMITED TO, PERMANENT OR PARTIAL DISABILITY, ILLNESS OR DEATH TO HUMAN OR DOG(S); AND (b) THERE MAY BE OTHER RISKS NOT KNOWN TO YOU OR CAMP MIRACLE PAWS, NOR READILY FORESEEABLE AT THIS TIME (COLLECTIVELY, “RISKS”). YOU FULLY ACCEPT AND ASSUME ALL RISKS AND RESPONSIBILITY FOR ALL RISKS, INCLUDING, WITHOUT LIMITATION, ALL LOSSES, COSTS AND DAMAGES INCURRED AS A RESULT OF YOUR CAMPER’S PARTICIPATION AT CAMP MIRACLE PAWS, INCLUDING ANY VETERINARIAN EXPENSES INCURRED ON BEHALF OF OR CAUSED BY YOUR CAMPER. “SICKNESS” INCLUDES ANY ILLNESS NOT LIMITED TO BORDETELLA (KENNEL COUGH), BLOAT, TORN ACL’S, BITES, OR ANY OTHER FORM OF CONTAGIOUS DISEASE.

WAIVER, RELEASE AND INDEMNIFICATION. YOU HEREBY AGREE TO EXPRESSLY AND FOREVER GENERALLY WAIVE, DISCHARGE CLAIMS, INDEMNIFY, RELEASE FROM LIABILITY, SAVE, HOLD HARMLESS AND DEFEND Camp Miracle Paws, their invitees, owners, officers, directors, employees, contractors, volunteers, agents, representatives, lessors, and all others having an interest in any Camp Miracle Paws party (collectively, the “Releasees”) from and against ANY AND ALL INJURY, LIABILITY, CLAIMS, LITIGATION, ACTIONS, SUITS, COSTS, LOSSES, DAMAGES, ATTORNEY’S FEES, EXPENSES OR DEMANDS OF EVERY CHARACTER WHATSOEVER on account of, arising out of, resulting from or relating in any way to (i) any act or omission of the Releasees, (ii) your Camper’s participation at any Camp, pet training services, or otherwise. YOU AGREE THAT THIS RELEASE IS BINDING ON YOU AND YOUR SUCCESSORS, HEIRS, LEGAL REPRESENTATIVES AND ASSIGNS. YOU ALSO EXPRESSLY AND FOREVER RELEASE CAMP MIRACLE PAWS FROM ANY DUTY TO PROTECT YOU OR YOUR CAMPER FROM INJURY OF ANY KIND, AND AGREE THAT ANY IMPLEMENTATION OF SAFETY PRECAUTIONS BY CAMP MIRACLE PAWS WILL NOT WAIVE CAMP MIRACLE PAWS’S RIGHT TO BE INDEMNIFIED AS PROVIDED HEREUNDER, AND SUCH PRECAUTIONS WILL NOT ALTER THIS RELEASE. I INTEND FOR THIS AGREEMENT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY OF CAMP MIRACLE PAWS TO THE GREATEST EXTENT PERMITTED BY LAW; I AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID OR UNENFORCEABLE, THE REMAINDER OF THIS AGREEMENT WILL REMAIN IN FULL FORCE AND EFFECT.

All new and regular campers must:

  • be current on Rabies, Distemper, Parvo and Bordetella vaccinations;
  • be at least 4 months of age (only required for Daycare or Boarding Camp);
  • be spayed or neutered if 10 months of age or older and no pregnant or in-heat females are allowed (only required for Daycare or Boarding Camp);
  • be in general good health and free of ticks and fleas (only required for Daycare or Boarding Camp);
  • be non-aggressive towards other dogs and people;
  • complete the Camp Miracle Paws evaluation interview process to Camp Miracle Paws satisfaction in its sole discretion;
  • meet all municipal and state licensure and other requirements;
  • have a quick release collar that contains an identification tag bearing the Camper’s name and guardian or owner’s current contact information; (only required for Daycare or Boarding Camp)
  • have a martingale collar that contains an identification tag bearing the Camper’s name and guardian or owner’s current contact information; (only required for Training Classes)
  • be leashed when entering and exiting Camp. (Retractible Leashes are NOT ALLOWED)
  • camper parents must wear closed toed shoes that provide adequate support when participating in any training or playgroup classes, no flip-flops are allowed;
  • camper families will be limited to three humans per dog when participating in any training or playgroup classes.

Fees. You must pay for all services and products by credit card, cash or check. All payment is due at the time you pick up your Camper from Camp or at the time pet care or training services are agreed upon. You give your express permission for Camp Miracle Paws to charge any credit card you provided for unpaid services or products upon the date services were supposed to have been completed. You further agree to pay any collections costs and the cost of any returned or challenged check or debit charges.

Training and Interviews. You hereby consent to the Camp’s use of your Camper for staff training, dog training, and new Camper interviews while your Camper is in our care or while participating in social classes. You acknowledge that dogs in Camp for training or interview purposes may not meet all Camper guidelines qualifications.

Cancellation and Refund Policy. Refund and prorated policies differ between each Camp location and are available upon request.

Duty to Disclose. You must disclose on a continuing basis, any and all medical or other conditions, including but not limited to personality concerns or behavioral incidents that in Camp Miracle Paws’s sole discretion, may affect, limit or prevent your Camper’s ability to participate in any Camp activity or training services.

Appointments and Reservations. Appointments and Reservations are accepted but not guaranteed without first meeting Camp Miracle Paws’ requirements.

Your Emergency Agent. You must provide an adult, over the age of 18, as your Agent. Your Agent must also be someone other than the primary Dog Parent(s) and should not be someone traveling with you if you are leaving town. If we cannot reach you, you authorize us to contact your Agent. You agree that your Agent shall have your full and complete authority to make any and all decisions including those related to the health of your Dog and the expenditure of funds for or on behalf of you and your Dog.

Emergencies. In an emergency or natural disaster every effort will be made to contact you or your Agent to retrieve your Dog. You agree that Camp Miracle Paws, at its sole discretion, is authorized to transport and/or to make temporary alternative arrangements to house and care for your Dog until you or your Agent can retrieve the Dog. You understand it may not always be possible to safely evacuate your Dog.

Check-In and Checkout. Camp Miracle Paws is open for check-in and check-out as agreed at the time your appointment or reservation is confirmed. We may require government issued identification before releasing the Dog(s) as we want to be sure we only release your Dog(s) to you, your Agent or such other individual(s) designated by you in writing as authorized to pick up your Dog.

Pet Health and Behavior. We reserve the right to refuse to accept a Dog at check-in and arrangements for an early pick up of the Dog will be made by owner or agent if for any reason, including without limit, if it ever appears to us the Dog is agressive, anxious, appears to be an escape artist, is potentially contagious, has fleas, ticks, is sick, injured, in pain, or that its behavior could jeopardize the health or safety of other Dogs and or our staff. No Dog can stay with us or set up any appointments unless the Dog is healthy and we have confirmation from a licensed veterinarian or approved designee that the Dog has received all vaccinations required by Camp Miracle Paws and a health letter of clearance if the dog has been experiencing illness PRIOR to your dogs arrival. It is important to make sure your Dog has been vaccinated and on a flea and tick preventative for at least thirty (30) days prior to boarding. We may accept some older Dogs and we may administer routine medication for chronic non-contagious conditions, but we are not equipped to care for acutely sick Dogs, contagious, aggressive or biting, anxious Dogs. We have no control over nature and if your Dog passes or is injured during our care; Camp Miracle Paws will not be held responsible. You represent that to the best of your knowledge your Dog is in good health and has not been exposed to rabies, distemper, or parvovirus or any medical conditions seen or unforeseen prior to beginning its stay with us. If your Dog has been treated for a contagious illness, we cannot accept your Dog for at least two (2) weeks after treatment has been completed and a statement of health is obtained from a licensed veterinarian. You acknowledge that we may contact appropriate authorities if your Dog is contagious, or bites another Dog or any person. You acknowledge and agree that in the unlikely event your Dog becomes ill or injured, or if your Dog has a pre-existing condition which is aggravated by its stay, and requires professional attention, we will promptly attempt to notify you or your Agent at the telephone numbers you provide. If we cannot reach you or your Agent, Camp Miracle Paws at its sole discretion, may engage the services of a licensed veterinarian and/or administer medicine or give other necessary attention to your Dog, and you authorize us to provide any such service at your additional expense. In cases we believe to be critical, we may take your Dog to the veterinarian first before trying to contact you. If you refuse medical treatment for your Dog, Camp Miracle Paws, at its sole discretion, may engage the services of a veterinarian and/or administer medicine to make your Dog as comfortable as possible until picked up by you or your Agent, and you authorize us to provide any such service at your additional expense. If we cannot reach you or your Agent, we will make healthcare decisions for your Dog based on the recommendations of available professionals. In the unfortunate event that your Dog passes away while in our care, we will transport your dog to a local licensed veterinarian of our choice that will communicate directly with the owner and will hold your Dog until you or your Agent are able to make arrangements

Contact with Other Dogs and Acts of Nature. While your Dogs is staying with us he or she will come into contact with other Dogs and Acts of Nature. Every effort will be made to ensure the safety of our guests by enforcing strict restrictions on Dogs as set forth in Camp Miracle Paw’s guidelines. Dog Owner is aware that Camp Miracle Paws is located in a country setting and as part of Camp Miracle Paws goal to keep Dogs safe and healthy, their staff follows strict guidelines for cleansing kennels and lawn maintence with Dog friendly products. However, Dogs might come into contact with things like fungus, sticks, grass, insects, snakes and other acts of nature. You acknowledge and agree that in the unlikely event your Dog becomes ill or is injured in an accident or by another Dog, YOU RELEASE CAMP MIRACLE PAWS AND ITS AGENTS FROM ANY LIABILITY FOR SUCH INJURY. If your Dog injures another Dog, you will be solely responsible for any injury and legal costs to the other Dog(s) as well as your own Dog, and YOU RELEASE CAMP MIRACLE PAWS AND ITS AGENTS FROM ANY LIABILITY FOR ANY AND ALL SUCH INJURIES. Communicable diseases: all Dogs coming into the Camp Miracle Paws are required to be vaccinated. However, it is still possible for a Dog to become ill, even if vaccinated. You understand this risk and agree that Camp Miracle Paws is not liable for any illness suffered by your Dog during or after its stay, including but not limited to Kennel Cough, Respitory, Skin, Gastro Infections and Tracheobronchitis (Canine Cough).

Pets not picked up on Departure Date. If you or your Agent do not pick up your Dog at the agreed upon time, you hereby authorize us to continue to provide the Services as set forth in this Agreement at your expense. If Camp Miracle Paws Org determines, at its sole discretion, that an extension of Services is required, payment in full may be required prior to extending such Services. Notwithstanding the foregoing, if your Pet is deemed abandoned under local, state, or federal laws or regulations, or in Miracle Paws discretion as permitted by law, we will follow the Abandoned Pet Procedure.

Abandoned Pet Procedure. Unless otherwise required by applicable law, if you fail to pick up your Dog by the designated time: All Services will stop, with the exception of medication administration necessary to ensure Pet health and safety and basic boarding services (food, water, relief and playtime and shelter). Camp Miracle Paws’ guests may be converted to boarding services if the Dog has not been picked upwithin the agreed hours and you shall pay the expense; we will attempt to contact you by telephone and/or in writing using the information that you have provided, advising you that if your Pet is not picked up within a reasonable time period, your Pet will be deemed to be abandoned and that Camp Miracle Paws will follow South Carolina’s abandonment laws and will attempt to rehome the Dog or will deliver the Pet to a third party adoption partner or as a last resort will deliver the Dog to Animal Control, or other similar government agency. You understand that you may lose ownership of your Pet under these circumstances. If you fail to pick up your Pet for any reason, YOU RELEASE CAMP MIRACLE PAWS FROM ALL FURTHER LIABILITY AND RESPONSIBILITY FOR YOUR PET. You shall remain liable to us for all unpaid Charges, including without limit the court costs and reasonable attorneys’ fees incurred in the collection of the Charges.

Your representations to us. You represent to us that you are the owner of the Pet and that you are fully authorized to enter into this Agreement. All of the information about you and your Pet in this Agreement is true, accurate and complete. In a custody dispute, we will exercise reasonable judgment based on the known facts and we may, in our sole discretion, require proof of ownership, a written property settlement agreement or court decree. To the best of your knowledge, your Pet has no illness, injury or behavior problem (including aggressive, biting, has anxiety or is unruly, is contagious, or is displaying escape artist behavior) that has not been disclosed to us. You agree to indemnify and hold us harmless, from and against all loss, damage or expense, including attorneys’ fees, resulting from misrepresentations by you or your representatives, or resulting from your Pet’s stay including, without limitation, any person claiming to be the owner of your Pet and any person claiming damage or injury by your pet.

Personal items. Do not bring items with your Pet that are valuable or irreplaceable. Camp Miracle Paws is not responsible for loss or damage to any personal item or toy left with your Pet. Owners are expected to provide copies of current vaccination records, ample food, medication and preventatives for the Dog.

No Representations, Warranties, Guarantees. Camp Miracle Paws makes no representations, warranties or guarantees of any kind with respect to the temperament, or behavior of the dog.

Release and Indemnification by Client. Client, on behalf of himself or herself and all representatives, agent, successors or assigns, hereby releases Miracle Paws and its affiliates, agents, officer, directors, employees, independent contractors, volunteers and representatives, from any and all liability for personal injury, property damage, legal fees, claims, demands, actions, suits, causes of action, obligations, damages and liabilities or whatever kind or nature which may arise after Client obtains possession of the dog out of any occurrences, acts or omissions in any way connected with Client’s ownership of the dog, possession of the dog or handling of the dog by (b) Client, on behalf of himself or herself and all representatives, agent, successors or assigns, agrees to indemnify, protect and hold harmless Camp Miracle Paws and its affiliates, agents, officer, directors, employees, independent contractors, volunteers and representatives, from any and all liability for personal injury, property damage, legal fees, claims, demands, actions, suits, causes of action, obligations, damages and liabilities or whatever kind or nature which may arise after the date Client obtains possession of the dog out of any occurrences, acts or omissions in any way connected with Client’s ownership of the dog, possession of the dog or handling of the dog by Client or the dog handler.

Non-Disparagement. Client agrees not to make any statements, written or verbal, or cause or encourage others to make any statements, written or verbal, including but not limited to any statements made via social media, on websites or blogs, that defame, disparage or in any way criticize the reputation, practices, or conduct of Miracle Paws. Client acknowledges and agrees that this prohibition extends to statements, written or verbal, made to anyone, including but not limited to the news media, competitors, and other clients of Miracle Paws. Client further understands and agrees that Miracle Paws would be irreparably harmed by violation of this provision.

Non-Disclosure of Trade Secrets. Client agrees to hold Miracle Paws’ trade secrets in trust and strictest confidence to the fullest extent contemplated and permitted under the South Carolina Trade Secrets Act, S.C. Code Ann. § 39-8-10, et seq., and will in no event take any action causing or fail to take any action necessary in order to prevent any such trade secrets to lose their character or cease to qualify as trade secrets. The parties agree that Miracle Paws has taken reasonable means to control and restrict disclosure of its trade secrets.

Photo Release. Client grants to Camp Miracle Paws, its representatives, and employees the right to take photographs of Client and/or Client’s dog in connection with the activities described in this Agreement. Client authorizes Camp Miracle Paws, its assigns and transferees to copyright, use and publish the same in print and electronically. Client agrees that Camp Miracle Paws may use such photographs of Client and/or Client’s dog with or without Client’s name and for any lawful purpose, including but not limited to, publicity, illustration, advertising and web content.

Termination. Camp Miracle Paws shall terminate its training services if Camp Miracle Paws determines in Camp Miracle Paws’ sole discretion that Client’s dog is dangerous or vicious to a person or animal. In the event of such termination, all fees paid or funds paid by Client shall remain the sole property of Camp Miracle Paws.

Entire Agreement. This Agreement sets forth all of the promises, covenants, agreements, conditions and understandings between Camp Miracle Paws and Client with respect to the subject matter hereof, and supersedes all prior and contemporaneous agreements, understandings, inducements or conditions, express or implied, oral or written, with respect thereto, except as contained here­in.

Breach of Agreement. If either party believes the other party has breached a term of this Agreement, the non-breaching party shall notify the breaching party in writing of the alleged breach within 10 days of discovery of the facts constituting the alleged breach, and the breaching party shall have 10 days to cure such breach. Each party agrees to attempt to settle disputes in a respectful manner. If the parties are unable to settle any dispute between themselves, then either party may bring a claim for breach of the terms of this Agreement, and the prevailing party shall be entitled to its reasonable attorneys’ fees and expenses incurred in prosecuting or defending such an action.

Governing Law, Jurisdiction, and Venue. This Agreement has been entered into under and shall be governed by the laws of the State of South Carolina without reference to or application of the choice-of-law or conflicts-of-laws principles, policies, or holdings of any jurisdiction. The parties agree that the State Court of Anderson County, South Carolina or the Federal District Court for the District of South Carolina, Anderson Division, shall be the sole and exclusive jurisdiction and venue for all disputes between the parties under this Agreement. Client hereby irrevocably consents to the jurisdiction and venue of these courts for adjudication of all disputes between the parties under this Agreement. Client hereby waives any objections or defenses to jurisdiction or venue in any such proceeding before such court.

Assignment. Neither party hereto may assign its rights or obligations under this Agreement without the prior written consent of the other party hereto, and any such prohibited assignment shall be void.
Definitions. The terms used throughout this Agreement, whether capitalized or not, and in either thesingular or plural form, shall mean as follows: “We,” “us,” and “Camp” mean Camp Miracle Paws and its subsidiaries. “You” and “your” shall mean the Pet Parent(s) signing this Agreement. “Pet” shall mean the Dog(s) and cat(s) staying at Camp Miracle Paws and “your Pet” shall refer to the Pet(s) designated by the Pet Parent in this Agreement. You have read this entire Agreement, you have had the opportunity to discuss it with us to your satisfaction.
